Terms of Service

By creating an account or using the Service you agree to these Terms. If you are acting for an organization, you confirm that you have authority to bind that organization.

SmarterPaws is rescue and shelter operations software. It includes intake, a review inbox, dog and medical records, cost tracking, adopter and foster portals, application scoring, messaging, e-signature documents, analytics, and an optional public adoption site with donations. Features may change over time.

• Provide accurate information and keep it current.
• Keep credentials secure and accept responsibility for activity under your account.
• You must be at least 18 years old.
• Notify sofia@smarterpaws.ai of any unauthorized use.

Paid plans are Starter at $49 per month, Growth at $99 per month, and Pro at $249 per month, billed monthly or annually with about 15 percent off annual. Subscriptions renew automatically unless canceled before renewal. Payments are processed by Stripe. Fees are non-refundable except where required by law. Failed payments may result in suspension.

The customer owns and controls Customer Data and is the controller of it. The customer is responsible for having a lawful basis, providing notices, honoring privacy rights, and using the Service lawfully. SmarterPaws processes Customer Data on the customer's behalf under these Terms and the Data Processing Addendum. The customer grants SmarterPaws a limited license to host, process, and transmit Customer Data in order to provide the Service.

• No illegal use of the Service and no violating the rights of others.
• No malware, and no probing of security or data-isolation controls.
• No accessing data belonging to other organizations.
• No unlawful or unsolicited messaging. Comply with TCPA, CAN-SPAM, and carrier rules.
• No scraping or overloading the Service, and no reselling it.
• Obtain consent before texting or emailing people.

The customer obtains consent and complies with messaging laws. Message and data rates may apply. Messaging features may be suspended for abuse.

Donations are processed through the rescue's own connected Stripe account and are paid to the rescue. SmarterPaws is a facilitator only and is not responsible for donation transactions, tax treatment, receipts, or refunds. The customer is responsible for charitable-solicitation registration and donor acknowledgments.

Stripe, Twilio, our email provider, and AI providers may have their own terms that apply to your use of those services.

SmarterPaws owns the Service, excluding Customer Data. You receive a limited, non-exclusive right to use the Service during your subscription. You may not copy, reverse engineer, or create derivative works from the Service.

Each party protects the other's non-public information. Feedback you send us is licensed to us royalty-free.

We use reasonable efforts to keep the Service available, but we do not guarantee uninterrupted or error-free operation. Maintenance and changes are permitted.

The Service is provided "as is" and "as available", and warranties are disclaimed to the extent permitted by law. The application-scoring feature is decision support only, and the customer is solely responsible for all adoption, foster, and screening decisions.

Neither party is liable for indirect, incidental, special, consequential, or punitive damages. Total liability is capped at the amounts paid in the prior 12 months.

The customer indemnifies SmarterPaws against claims arising from its Customer Data, its use of the Service, its violations, or its messaging or donation activity.

You may cancel at any time, effective at the end of the current term. SmarterPaws may suspend or terminate for breach, non-payment, or risk. Post-termination data handling follows the Data Processing Addendum, including an export window.

We provide reasonable notice of material changes to these Terms. Continued use is acceptance.
